Who we are
The Smarter Position is a U.S.-based educational-media publication. It operates this website and newsletter and controls the subscriber information described below. Privacy requests may be sent to [email protected].
Information we collect
When you sign up for our email list, you provide your email address. In addition, our email platform, Kit, automatically processes certain information in connection with the signup form and the emails we send:
- Your email address
- IP address
- Signup date and signup source
- Device and browser information
- Approximate location derived from your IP address
- Cookie and navigation data on Kit-hosted pages
- Email-engagement information, such as whether an email was opened or a link was clicked
This website itself does not require an account and does not ask for personal information.
How we use it
Your information is used to send you the content you signed up for—the Pre-Trade Risk Checklist and our email lessons and updates—and to understand, in aggregate, how our emails perform. We do not sell or rent your personal information, and we do not share it with third parties except the service providers described below.
Service providers
Our email list is managed by Kit, which stores subscriber information and sends our emails on our behalf. See the Kit Privacy Policy and the Kit Data Processing Addendum. Signup forms and pages hosted by Kit may set cookies under Kit's own policies.
This website is served by Cloudflare, which may process standard technical request data (such as IP addresses) to deliver and secure the site, and which provides the privacy-focused Web Analytics described below, as explained in the Cloudflare Privacy Policy.
Cookies, analytics, and tracking signals
This website uses Cloudflare Web Analytics, a privacy-focused performance analytics service. Cloudflare automatically injects a JavaScript performance beacon that collects page-level usage and performance metrics. According to Cloudflare, the beacon does not store or access cookies, local storage, session storage, or other browser storage, and it does not track visitors across unrelated websites. Cloudflare receives the source IP address through normal request handling but states that it discards the address at the nearest data center rather than storing it in its analytics databases. We do not use advertising trackers, sell or share personal information for targeted advertising, or perform cross-context behavioral advertising. Because we do not sell or share personal information or track you across unrelated sites, Global Privacy Control and Do Not Track signals do not change this site's behavior. Kit-hosted pages may use necessary cookies and similar technologies under Kit's own policies.
How long we keep information
We retain subscriber information while you remain subscribed. After an unsubscribe or deletion request, we retain only information reasonably necessary to honor the request, meet legal obligations, maintain security, or resolve disputes. Backup copies may remain temporarily until overwritten under our service providers' normal retention schedules.
Unsubscribing and deletion
Every email we send includes an unsubscribe link that takes effect immediately. When you unsubscribe or request deletion, we will delete or anonymize your personal information where required, except for limited records reasonably necessary to honor your unsubscribe request, comply with legal obligations, prevent abuse, or maintain secure backups.
Your rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate information
- Delete your information
- Withdraw consent and unsubscribe at any time
- Object to direct marketing
- Request a portable copy of your information, where applicable
- Submit a privacy complaint

International transfers and lawful basis
Our newsletter processing relies on your consent, which you may withdraw at any time by unsubscribing or contacting us. Kit processes data in the United States and other countries. For applicable international transfers, Kit participates in the Data Privacy Framework and uses contractual safeguards. If you are in the European Economic Area, the United Kingdom, or another jurisdiction with a data-protection authority, you may also lodge a complaint with your local authority.
Children
Our content and email list are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. Contact us if you believe a child has subscribed.
